Off-Label Ruling Is A Victory for Free Speech

Suppose an article in the New England Journal of Medicine reports on a new use for a drug that has been on the market with the Food and Drug Administration approval for some time. The drug turns out to be a surprisingly effective weapon against certain forms of cancer. Of course not everyone subscribes to the New England Journal of Medicine. Even those who do, don’t read every article. This is especially true of busy doctors who don’t have a lot of spare time on their hands.
