Borrowers' Defense Shouldn't Work to Scam Taxpayers

College is not supposed to be free — you either pay for it, get a scholarship, or take out a student loan you’re expected to repay in a reasonable rate of time. Unfortunately, the Biden administration’s Department of Education (DOE) is inappropriately using an Obama-era program, the “Borrower Defense to Repayment” (BDTR) program, to forgive billions of dollars’ worth of student loan debt without cause or reason.  

According to DOE, BDTR is a tool to be used by those who were misled or defrauded by their institutions that discharges some or all of their student loans incurred during their time in school. On paper, BDTR sounds like a sensible safety net for vulnerable students who were genuinely deceived by their schools — whether it be through financial or educational means. However, when the amount of loans forgiven reaches a staggering amount of more than $9.5 billion, Americans have to start wondering whether any of their tax money is being spent on false claims.  

It is DOE’s responsibility to vet each and every claim they receive under BDTR and approve only legitimate claims for discharge. As we can confidently see, they are approving much more than that. Even more concerning is the fact that internal agency documents have revealed that DOE is planning a mass discharge of meritless claims.
