Economic regulation rarely directly impacts national security. Yet, Congress seems bound and determined to take a forced march through antitrust law, with the inevitable result of increasing cybersecurity risk.
The American Innovation and Choice Online Act, the American Choice and Innovation Online Act and the Open App Markets Act are designed to make several common business practices used in the tech industry illegal under antitrust law. But, as a group of former national security officials recently put it, the legislation would have grave security risks and might “unintentionally curtail the ability of these platforms [to] safeguard the security of their users in the U.S. and globally.” The revised version of the American Innovation and Choice Online Act makes no substantive change and therefore, does not solve the substantial national security concerns with the legislation.
